A doctor in the US has reportedly won the right to a trial after alleging she was involved in an unprovoked attack by Johnny Depp's bodyguard at a concert last December.

U.C. Irvine medical professor Robin Eckert has been allowed to seek punitive damages by a Los Angeles Judge against the actor after a scuffle involving his bodyguard allegedly injured Ms Eckert and exposed her bum.

The suit, originally filed in April claimed, according to the New York Daily News, claimed the bodyguard bear hugged the married 53 year-old her from behind, handcuffed her and dragged her along the floor of the venue until her trousers fell down.

Ms Eckert alleges she suffered cuts, bruising and mental trauma resulting from the accident as well as a pre-existing fibromyalgia condition being exacerbated by the incident. At the time, the alleged victim claimed she was off work due to a disability that meant she walked with a cane.

According to the Los Angeles Times, Depp's legal team claim the behaviour was provoked by Ms Eckert's hostile actions and therefore "consented to any assault and battery" by the bodyguard.

A representative for the star has been contacted.
